  • Any non-domestic building > 12 kW

    The trigger is combined nominal cooling capacity, not floor area. Once installed AC across the building totals 12 kW or more, TM44 applies — whether the units are split, VRV/VRF, chiller-based or a mix.

  • Every 5 years, without exception

    Inspections must be lodged on the national register at least every five years. Missing the deadline is a criminal offence carrying a fixed £300 penalty per building, per report — and the clock does not reset.

  • Owner or operator obligation

    The duty sits with whoever controls the AC — usually the freeholder or FM on multi-let sites, but the operator on single-let. Landlords increasingly assign it to tenants at lease grant.

What is the penalty for not having a TM44?
The fixed penalty for failing to hold a valid, lodged TM44 report is £300 per building per report, enforced by trading standards. Failure to produce the report on request carries a further £200 penalty. Both are recoverable during due-diligence at sale, refinance or lease surrender.
How long does a TM44 inspection take?
